Is Class A1 Driver's License issued to People with Disabilities?

1 What is a Disabled Person?

Clause 1, Article 2 of the Law on People with Disabilities stipulates: a person with a disability is a person who has one or more parts of the body that are defective or have reduced function manifested in the form of a disability; causing them to encounter difficulties and obstacles in activities such as living, studying, working...

According to Article 3 of the Law on People with Disabilities 2010, types of disabilities include:

  • Visual disability.
  • Hearing and speech disabilities, neurological and mental disabilities.
  • Movement disability.
  • Intellectual disability and other disabilities.

There are 3 levels of disability specified in Article 3 Decree 28/2012/ND-CP:

  • The disability is particularly severe: are people who have completely lost all bodily functions due to disability. Therefore, they cannot control themselves or perform simple activities such as changing clothes, walking, personal hygiene... but require complete assistance, monitoring and care from others.
  • Severe disability: are people who have lost part of or have reduced body functions due to disability. They cannot control or perform some basic activities on their own such as personal hygiene, dressing, walking... but need complete help, monitoring and care from others.
  • Slight disability: is a person with a disability who does not fall into the cases of particularly severe disability or severe disability.

2 Can People with Disabilities Get a Class A1 Driver's License?

Based on the Driver's Health Standards Table at Appendix I Joint Circular No. 24/2015/TTLT-BYT-BGTVT People with one of the following medical conditions will not be eligible to drive a class A1 vehicle:

  • Motor paralysis of two or more limbs.
  • Loss of function or amputation of a hand, a foot or a foot and the other hand is no longer intact due to amputation or functional impairment.
  • People in a state of acute mental disorder or chronic mental disorder cannot control their behavior.
  • People with distance vision in both eyes <4/10 or vision in one eye <4/10; including cases corrected with glasses.
  • People with disorders of the ability to recognize 3 basic colors: red, blue, yellow.
  • Using drugs or substances with alcohol concentrations exceeding the prescribed level.

Thus, depending on the degree of deformity, the People with disabilities can register for the A1 driver's license test/issue including:

  • People who are deaf (hearing impaired).
  • People with paralysis can move one leg or one arm, but the remaining limbs do not lose motor function.
  • A person has an amputated or lost function of one arm but the remaining limbs are still intact.

Combining provisions in Clause 3, Article 59 of the Road Traffic Law 2008, amended and supplemented in 2019: Granting class A1 driving licenses to people with disabilities operating 3-wheeled motorbikes.

From the above information, it can be seen that in some cases people with disabilities can still be granted a class A1 driving license, but this only applies to 3-wheeled vehicles used specifically for people with disabilities according to regulations.

3 Validity period for Class A1 Driver's License for People with Disabilities

Article 17 Circular 12/2017/TT-BGTVT Added by Clause 3, Article 2 of Circular 01/2021/TT-BGTVT Regulations on the validity of driving licenses are as follows:

  • Driving licenses A1, A2, A3: no expiration date.
  • Class B1 driver's license: validity is determined by the driver's age (55 years old for women and 60 years old for men).
  • Class A4, B2 driving license: valid for 10 years from date of issue.
  • Class C, D, E, FB2, FC, FD, FE driving licenses: valid for 05 years from the date of issue.

Thus, class A1 driving licenses for people with disabilities will not have an expiration date.

4 Time to issue new Class A1 Driver's License for People with Disabilities

Article 35 Circular 12/2017/TT-BGTVT added by Clause 5, Article 2 of Circular 01/2021/TT-BGTVT and modified by Point a Clause 2 Article 12 Circular 05/2023/TT-BGTVT Regulations on issuance of new driving licenses are as follows:

  • The date of admission recorded on the back of the driver's license is the date the decision to accept the test is signed.
  • Individuals who pass the test and need a driving license will be issued a driving license no later than 10 working days from the end of the test.
  • If an individual who has passed the test results wants to receive a driver's license at home, they need to register through the online public service system (done within 03 days from the end of the test).

Thus, it can be determined that people with disabilities will be granted a class A1 driving license within no more than 10 working days from the end of the test.
